- The Mayor appoints members from a list of nominees submitted by the Fine Arts Federation of New York containing not less than three times the number to be appointed; if no list is submitted within three months of a vacancy, the Mayor appoints without it.

- Members must be residents of the city. The Commission includes an architect, landscape architect, painter, sculptor and three lay members, as well as representatives of the Brooklyn Museum, the Metropolitan Museum of Art, the New York Public Library and the Mayor.
